According to the plaintiff's affidavit, Diallo persuaded him in September 2017 to purchase a 2010 Porsche Cayenne for $15,700, with the stated plan of reselling it overseas — specifically in Mali — at a profit.
The claim, and the contradiction
Diallo later told him the car had been shipped to Mali, according to a citation to her deposition testimony in the plaintiff's filings (p. 17, lines 8–12). In the same deposition, according to those filings, she admitted she could not provide any proof that the car had actually been shipped overseas (p. 16, lines 2–5).
The plaintiff's filings cite a Texas vehicle emissions test record placing the car in Houston well after the date it was supposedly shipped abroad — evidence offered to show the car never left the state, let alone the country.
The plaintiff's exhibits also include photographs he says he took of Diallo posing near the Porsche Cayenne on September 29, 2017, in St. Petersburg, Florida — shortly after the purchase and before the car's supposed export.
